Description

The sole issue presented by this certified appeal is whether the guilty plea of the defendant, Karol Domian, was entered knowingly, voluntarily and intelligently, notwithstanding the trial court's failure to inform him of the mandatory minimum sentence. The defendant pleaded guilty to the crime of arson in the first degree, *fn1 a class A felony punishable by a term of imprisonment of not less than ten nor more than twenty-five years, *fn1 and was sentenced to a prison term of ten years. The defendant appealed from the judgment of conviction to the Appellate Court claiming that the trial court's failure to inform him of the mandatory minimum sentence violated his federal constitutional right to due process and, therefore, that he was entitled to withdraw his plea and proceed to trial. *fn1 The Appellate Court concluded that, under the circumstances presented, the defendant had not established a constitutional violation and, accordingly, affirmed the judgment of the trial court. State v. Domian, 35 Conn. App. 714, 646 A.2d 940 (1994). We granted the defendant's petition for certification, *fn1 and now affirm the judgment of the Appellate Court.
